Sin embargo, el sistema legal de la aviaci\u00f3n comercial internacional, sustentado en los Convenios Bilaterales de Transporte A\u00e9reo, inspirados en los principios y acuerdos derivados de la Convenci\u00f3n de Chicago de 1944, cuna de la Organizaci\u00f3n de Aviaci\u00f3n Civil Internacional (OACI ), no le han permitido tener una din\u00e1mica de crecimiento m\u00e1s acorde con la globalizaci\u00f3n, a pesar de los esfuerzos de los diversos entes multilaterales que han venido trabajando por la integraci\u00f3n.<\/p>\n<p>En la subregi\u00f3n Caribe cohabitan: la Asociaci\u00f3n de Estados del Caribe (ASC),1994, y la Comunidad de Pa\u00edses del Caribe (Caricom), 1996, cada una con un Convenio de Transporte A\u00e9reo lleno de buenas intenciones, pero carentes de mecanismos para poder solucionar las trabas jur\u00eddicas existentes en las legislaciones de sus pa\u00edses miembros o los problemas de mercado que subyacen en la subregi\u00f3n.<\/p>\n<p>En Sudam\u00e9rica est\u00e1n: la Comunidad Andina de Naciones (CAN), 1973, con un Acuerdo de Transporte A\u00e9reo de 1991 por cierto, el m\u00e1s eficaz de toda la regi\u00f3n, y el denominado Mercado Com\u00fan de Suram\u00e9rica (Mercosur), 1991, liderado por Argentina, Brasil, Uruguay y Paraguay, con un Acuerdo de Transporte A\u00e9reo (Fortaleza de 1996) muy poco exitoso, y en Centroam\u00e9rica existe el Sistema de Integraci\u00f3n Centroamericano (SICA), que no posee acuerdo formal de transporte a\u00e9reo.<\/p>\n<p>Por otra parte, es importante citar la existencia de algunos Acuerdos de Cielos Abiertos, bilaterales o firmados por un peque\u00f1o grupo de pa\u00edses, los cuales, aunque solo han beneficiado a sus signatarios, sirvieron de referencia a la Comisi\u00f3n Latinoamericana de Aviaci\u00f3n Civil (CLAC) para impulsar un acuerdo regional amplio que elimine las barreras de la integraci\u00f3n en este campo.<\/p>\n<p>El Acuerdo promovido por la CLAC se inici\u00f3 en 2010, impulsado por Chile, cre\u00e1ndose un grupo ad hoc al que se incorporaron Brasil, Costa Rica, Cuba, Guatemala, Panam\u00e1 y Rep\u00fablica Dominicana, con la misi\u00f3n de proponer a la regi\u00f3n un Acuerdo Multilateral de Cielos Abiertos. El proyecto fue preparado originalmente por Panam\u00e1 y ampliado por Chile, tomando como referencia el modelo elaborado en la Conferencia Mundial de Transporte A\u00e9reo de la OACI de 2003 y los aportes y experiencias de los Estados que integraron el grupo. El texto del convenio se aprob\u00f3 en la XIX Asamblea de la CLAC , celebrada en Punta Cana (Rep\u00fablica Dominicana) en noviembre de 2010.<\/p>\n<figure id=\"attachment_27837\" aspectos que tradicionalmente han estado restringidos por los convenios bilaterales y multilaterales existentes:<\/p>\n<ol>\n<li>Derechos de transporte, permitiendo la libertad de transporte desde y hacia terceros pa\u00edses, as\u00ed como puntos m\u00e1s all\u00e1, conocidas como quinta y sexta libertades del aire.<\/li>\n<li>Libre designaci\u00f3n de empresas, lo que en la pr\u00e1ctica significa que cada pa\u00eds designa tantas empresas como considere necesario, y que a las mismas no se les exigen los requisitos de propiedad substancial y control gerencial efectivo por parte de nacionales de ese pa\u00eds.<\/li>\n<li>Libre capacidad: cada empresa designada decide el n\u00famero de frecuencias que operar\u00e1 en cada ruta, as\u00ed como el tipo de aeronave que asignar\u00e1 para las mismas, en funci\u00f3n del mercado.<\/li>\n<li>Tarifas no reguladas, por lo que cada empresa establecer\u00e1 las tarifas de sus servicios en base a sus costos y a la libre una verdadera revoluci\u00f3n en el transporte a\u00e9reo en la regi\u00f3n, este organismo no ha logrado convencer a varios Estados que tradicionalmente han defendido la bilateralidad como forma de desarrollo de sus servicios a\u00e9reos internacionales o como forma de proteger a sus l\u00edneas a\u00e9reas bandera, de las cuales son propietarios.<\/p>\n<p>Seg\u00fan la p\u00e1gina web de la CLAC , hasta octubre de 2017 los Estados que se han adherido al convenio o lo han ratificado son: Chile, Rep\u00fablica Dominicana, Uruguay, Guatemala, Panam\u00e1, Paraguay, Colombia, Honduras y Brasil; es decir, apenas 9 del total de 23 que aparecen en el acta final, 8 de Latinoam\u00e9rica y 1 del Caribe, lo cual sorprende, ya que varios pa\u00edses caribe\u00f1os, tales como Aruba, participan en convenios bilaterales de cielos abiertos en la regi\u00f3n.<\/p>\n<p>Este esfuerzo, que promueve la libre competencia y una mayor oferta de transporte, no puede perderse, por lo que hace falta que, adem\u00e1s de la CLAC , los Gobiernos y l\u00edderes regionales se conviertan en promotores del mismo, buscando lograr que se incorporen al menos otros estados por v\u00eda de ratificaci\u00f3n o adhesi\u00f3n, para alcanzar 17 miembros en total, que representar\u00edan el 75% de la meta inicial propuesta. En todo caso, los pa\u00edses que no se adhieran al convenio o no lo ratifiquen podr\u00e1n optar entre mantenerse dentro de la bilateralidad actual o integrarse a otros esquemas subregionales con similar objetivo.
